DUIs in Mississippi

In Mississippi, DUI arrests are not uncommon. On average, for every 100,000 drivers, there are over 250 DUI arrests. Under state law, a person may be charged with a DUI if they have a blood alcohol concentration of .08 for adults, .02 for minors, and .04 for those operating commercial vehicles. The term “under the influence” can be expanded beyond the effects of alcohol; it can also encompass other illegal substances or even prescription drugs that impair one’s motor functions.

Mississippi DUI laws can carry severe penalties, and it is important to understand the structure under which DUI penalties are enforced. In general, unless there are aggravating circumstances, the state follows a model of increased severity for every DUI offense. In general, this includes:

  • First offense. On its own, a first DUI is charged as a misdemeanor, which can carry a possible jail time of up to 48 hours. Fines often range between $250 and $1,000. In addition, there is the possibility of a driver losing their license for 90 days.
  • Second offense. In general, this is usually still charged as a misdemeanor, but it can carry more severe penalties. A person may face between five days and six months in jail. There are accompanying fines of between $600 and $1,500, and a driver’s license may be suspended for as long as one year.
  • Third offense. This is a felony. It can carry a minimum of up to one year in jail, with the potential for five years. A person found guilty of a third DUI offense may have to pay fines ranging between $2,000 and $5,000. License suspensions here may differ, but they could be for up to three years.

Common Defenses

Due to the high rate of incidents, the Jackson County Sheriff’s Department can be aggressive when enforcing DUI laws. Over the Memorial Day traveling period in 2022, over 1,615 DUI charges were issued within the state. Although no two DUI cases are the same, there are some common approaches an experienced defense attorney may consider when challenging such charges.

  • Reasonable suspicion. Under constitutional protections, a police officer cannot stop a driver arbitrarily. If there is any evidence that can undermine the legitimacy of a stop, it can greatly increase the chances of challenging a DUI allegation.
  • Equipment malfunction. While a BAC reading is often considered to be considerable evidence, there are many instances where the equipment used to conduct a field sobriety test fails to operate adequately. An officer may not have handled the device correctly, or external factors may have affected its performance.
  • Procedural violations. The police must follow many procedures when conducting a traffic stop. If any of these have been transgressed, it can undermine a charge and significantly increase the chances of a dismissal.

FAQs

Is It Worth Getting an Attorney for a DUI?

Yes, it is worth getting an attorney for a DUI. Whether you are facing a first offense or have a history of convictions, it is important to have representation defending your interests in the face of allegations. DUI cases can be complex, and several factors can affect their outcome. A skilled DUI attorney can provide valuable counsel on the right course of action for your case.

What Is the Ideal Plea Deal for a DUI?

There is no “ideal” plea deal for a DUI. Plea deals and DUI cases, in general, depend very much on the circumstances of the case. Factors such as the number of convictions a defendant has, as well as the property and personal damage involved, could all affect a deal. As such, it is important to hire a skilled DUI lawyer.

Do I Have to Go to Court for a DUI If I Have a Lawyer?

Yes. While a lawyer can represent your interests in court, there are certain instances, such as an arraignment, where you will likely need to be physically present. This is common in court cases. When you hire an attorney, they can provide informed counsel and represent your interests, but they usually cannot completely represent you in court without you showing up.

What Is the Ideal Defense Against a DUI?

There is no single, ideal defense against a DUI. Instead, there are common approaches that may bolster a defense. Some of these include:

  • Challenging the purpose of the stop
  • Questioning the functionality of field-testing equipment
  • Scrutinizing the procedures under which the police operated

A skilled defense attorney in Saint Martin often looks for discrepancies in these categories to enhance their clients’ defense in DUI cases.
